This Berkshires Experience Getaway promotion (“Getaway”) begins on January 31, 2008 and ends on February 2, 2009 (“entry period”).
How to Enter: Members of the Berkshire Visitors Bureau are not eligible to win the Berkshires Experience Getaway. The Getaway is open to all other legal residents of the United States 18 years of age or older at time of entry. There may be certain restrictions placed on when the winner is able to use the offerings in the Getaway and all offerings must be utilized in 2009. You will be automatically entered into a drawing for the Getaway when you complete and submit the entry form as specified during the entry period. Winner(s) will be selected in a random drawing and will be notified within 30 days from the end of the entry period and may be required to complete an affidavit of eligibility and release, allowing the Berkshires Visitors Bureau to use the winner’s name for publicity, except where prohibited. Getaway winners must respond within 15 days of notification, or the prize will be forfeited and an alternate winner selected. All decisions are final. No substitution, transfer, or assignment of the Getaway by the winner is permitted. Getaway may not be redeemed for cash or other consideration or exchanged for other offerings. Taxes are the sole responsibility of the winner. Odds of winning dependent on total entries received.
Non-winning entries will not be carried over into subsequent prize drawings.
No responsibility is assumed by the Berkshires Visitors Bureau for lost, late or misdirected entries or any computer, online, telephone, or technical malfunctions that may occur. The Berkshire Visitors Bureau is not liable for any claims made by the contributors of the Getaway and reserves the right to substitute a prize of equivalent value in the event the Getaway or any part thereof is unavailable. All entries become the property of the Berkshire Visitors Bureau and will not be returned. Entrants agree to abide by the terms off these official rules which are final and binding on all matters pertaining to this Getaway. By entering the Getaway, participants release and hold harmless the Berkshire Visitors Bureau, their respective officers, employees and agents from any and all liability or any injuries, loss, or damage of any kind arising from or in connection with this contest or any prize won.
If for any reason the Internet portion of the Getaway is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Berkshires Visitors Bureau that corrupt or affect the administration, security, fairness, integrity or proper conduct of this contest, the Berkshire Visitors Bureau reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Getaway. The Berkshires Visitors Bureau assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications-line failure, theft or destruction or unauthorized access to, or alteration of entries. The Berkshires Visitors Bureau is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, or software, or for failure of any email or entry to be received by the Berkshires Visitors Bureau on account of technical problem or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation or downloading any materials in this Getaway.
